Please read these Terms of Use ("Terms") carefully before using the SnapCal mobile application or website at snapcal.site (collectively, the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and SnapCal ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the updated Terms. We will notify you of material changes via the app or email.

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are under 18, you must have the consent of a parent or guardian.

SnapCal is a health and nutrition tracking application that uses artificial intelligence to identify food items from photos and estimate their caloric and nutritional content. The Service also provides tools for weight tracking, goal setting, water intake monitoring, and activity tracking. The nutritional information provided by SnapCal is intended for informational purposes only and is not a substitute for professional medical or dietary advice.

SnapCal offers the following subscription plans, processed through Apple's App Store:

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. No refunds are provided for unused portions of a subscription period, except as required by applicable law or Apple's refund policies.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, and the SnapCal AI — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. User Content

By submitting content (such as food photos or diary entries) to the Service, you grant us a limited, non-exclusive license to use that content solely to provide and improve the Service. You retain ownership of your content. We do not sell your personal content to third parties.

The Service provides nutritional estimates and health-related information for general informational purposes only. This information is not medical advice and should not be relied upon as a substitute for consultation with a qualified healthcare provider, dietitian, or physician. Always seek professional advice before starting any diet or fitness program. We are not responsible for any health outcomes resulting from use of the Service.

While we strive to provide accurate nutritional data, AI-based food recognition may not always be 100% precise. Calorie and nutrient estimates are approximations. We make no warranties regarding the accuracy, completeness, or fitness for any particular purpose of the nutritional information provided.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

17. Apple App Store Terms

If you download the Service from the Apple App Store, you acknowledge that: (a) these Terms are between you and us, not Apple; (b) Apple has no obligation to provide maintenance or support for the Service; (c) Apple is not responsible for any claims relating to the Service; and (d) Apple is a third-party beneficiary of these Terms and may enforce them against you.
